These Terms and Conditions (“Terms”) govern your use of the website www.organicyard.co.uk and all orders placed with Organic Yard (“we”, “us”, or “our”). By placing an order or using our website, you agree to be bound by these Terms.
We are a small UK business specialising in handmade and personalised jewellery. These Terms apply to both consumer (private) customers and wholesale/B2B customers (shops and retailers), with some differences noted.

2. Orders and Contract Formation

All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason.

A contract between us is formed only when we send you an order confirmation email.

Prices are shown inclusive of UK VAT (where applicable). We reserve the right to correct pricing errors before dispatch.

For wholesale/B2B orders, separate pricing, minimum order quantities, and payment terms may apply and will be agreed in advance.
3. Cancellation Policy
Because our jewellery is handmade and often personalised, we begin work on orders very quickly.

You may cancel your order within 6 hours of placing it by contacting us immediately via email. We will refund you in full (including delivery costs) if we have not yet started production.

After 6 hours, personalised or custom-made items cannot be cancelled. This is because materials may have been cut or work started specifically for your order.

Non-personalised standard items may be cancellable at our discretion if production has not begun, but we cannot guarantee this.

Once an item has been dispatched, cancellation is no longer possible (you may still have return rights for faulty goods — see below).
Important note for consumers: Under the Consumer Contracts Regulations 2013, you normally have a 14-day cooling-off period for distance sales. However, this right does not apply to personalised or made-to-your-specifications goods. Our 6-hour policy is more generous than required by law for non-personalised items.
4. Delivery and Shipping

We aim to dispatch orders within [e.g. 3–7 working days] for standard items and [e.g. 2–4 weeks] for personalised/handmade items. Exact timescales will be provided at checkout or in your order confirmation.

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by couriers or events beyond our control.

Risk in the goods passes to you upon delivery. Title (ownership) passes only after full payment.

For international orders, you are responsible for any import duties, taxes, or customs charges.
5. Returns, Refunds and Faulty Goods

Faulty, damaged, or mis-described items: You must notify us within 14 days of receiving the goods. We will arrange a full refund (including original delivery costs) or replacement/exchange once the item is returned in its original condition with proof of purchase. Return postage may be reimbursed at our discretion.

Change of mind / non-faulty returns:

Personalised or custom-made jewellery is non-returnable unless faulty.

Standard (non-personalised) items may be returned within 14 days of delivery for a refund, provided they are unused, unworn, in original packaging, and in resaleable condition. You are responsible for return postage costs.

All returns must be sent back to our returns address (provided upon request) with a returns note.

We inspect all returned items. Refunds will be processed within 14 days of receiving the goods back.

Hygiene items such as earrings are non-returnable for health and safety reasons unless faulty.
Statutory rights: Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose, and as described). You have up to 6 years to claim for faults in most cases, though the process changes after the first 30 days/6 months.
6. Our Liability

We are not liable for any indirect or consequential loss (e.g. loss of profit, data, or goodwill).

Our total liability to you shall not exceed the value of the goods you purchased.

We do not exclude liability for death, personal injury caused by our negligence, or any other liability that cannot legally be excluded.
7. Payment

We accept payment via [list your methods, e.g. credit/debit card, PayPal, Apple Pay].

Payment must be made in full at the time of ordering unless wholesale credit terms have been agreed.

All transactions are processed securely by our payment provider.
8. Intellectual Property and Website Use

All content on our website (images, text, designs, logos) is owned by or licensed to Organic Yard. You may not reproduce or use it without permission.

You grant us a licence to use any photos or descriptions you provide for personalised orders for the purpose of fulfilling your order and (with your consent) for marketing.
9. Wholesale / B2B Customers

Wholesale orders are subject to separate terms where agreed (e.g. minimum spend, payment on invoice, resale restrictions).

Wholesale customers do not have consumer cancellation or cooling-off rights.

You agree not to sell our jewellery below agreed minimum retail prices (if applicable) or pass it off as your own design.
10. Events Beyond Our Control (Force Majeure)
We are not liable for delays or failure to perform caused by events outside our reasonable control (e.g. strikes, pandemics, supplier issues, extreme weather).
11. Changes to These Terms
We may update these Terms from time to time. The latest version will be posted on our website with the “Last updated” date. Continued use of our site or placing orders after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts (or your local court if you are a consumer in Scotland or Northern Ireland).
13. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
